Terms of Service

By accessing or using the PRMF Premium Calculator ("Service"), you agree to these Terms of Service ("Terms").

These Terms govern your use of the calculator made available by the Association of Pension Trustees and Administrators of Kenya ("APTAK") and Kenbright ("we", "us", or "our").

If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years old and have authority to use the Service.

The Service provides indicative premium calculations for Post-Retirement Medical Fund (PRMF) contributions.

The calculator uses age, benefit option, and family size to generate indicative premium values. Ages 18-60 receive annual payment rates, and ages 61-90 receive lumpsum (one-time) payment rates.

Results are provided for information only and do not, by themselves, create a contract of insurance, confirm eligibility, or amend any PRMF rules, policy documents, or benefit approvals.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

- Use the Service for any illegal, fraudulent, or unauthorized purpose

- Attempt to gain unauthorized access to the application or underlying systems

- Interfere with, disrupt, or degrade the operation or security of the Service

- Upload or transmit malware, malicious code, or harmful content

- Use bots, scrapers, or other automated tools against the Service without written authorization

- Misrepresent your identity, authority, or affiliation with APTAK, Kenbright, or the PRMF

Violation of these rules may result in suspension of access or further action where appropriate.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE EXTENT PERMITTED BY LAW.

Indicative results only: calculator outputs are generated from the rates and inputs configured in the system at the time of use.

No binding commitment: a calculator result does not amount to enrollment, approval of benefits, final premium confirmation, or a guarantee that any rate will remain unchanged.

Input-dependent accuracy: inaccurate inputs, outdated information, or technical issues can affect the results displayed.

Operational availability: APTAK and Kenbright may update, suspend, or withdraw the Service at any time for maintenance, correction, security, or administrative reasons.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APTAK AND KENBRIGHT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.

- Loss arising from inaccurate user inputs or reliance on indicative calculator results as final decisions

- Loss caused by service interruptions, delays, or technical faults beyond reasonable control

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

You agree to indemnify and hold harmless APTAK, Kenbright, and their officers, employees, and agents, from claims, losses, liabilities, or expenses arising from:

- Your misuse of the Service

- Your breach of these Terms

- Your violation of applicable law or the rights of another person in connection with your use of the Service

This obligation survives termination of your use of the Service to the extent permitted by law.

All content, features, software, text, graphics, and branding in the Service are owned by or licensed to APTAK and Kenbright, and are protected by applicable intellectual property laws.

You are granted a limited, revocable, non-transferable right to use the Service for lawful PRMF-related informational purposes.

You may not copy, modify, distribute, reverse engineer, republish, or create derivative works from the Service except where permitted by law.

The APTAK name, logo, and related marks may not be used without prior written authorization.

APTAK and Kenbright may amend these Terms from time to time to reflect operational, legal, security, or service changes.

When material updates are made, we will revise the "Last Updated" date and may provide additional notice through the Service where appropriate.

Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.

If you do not agree to revised Terms, you must stop using the Service.

You may stop using the Service at any time.

APTAK and Kenbright may suspend, restrict, or terminate access immediately where necessary for security, operational, legal, or policy reasons, including breach of these Terms.

Sections that by their nature should survive termination will continue to apply after access ends.

These Terms are governed by the laws of the Republic of Kenya.

Any dispute arising from or relating to these Terms or the Service should first be raised with APTAK or Kenbright in good faith to allow internal review and resolution where possible.

Where a matter is not resolved amicably, it shall be handled in accordance with applicable Kenyan law and the jurisdiction of the competent courts or dispute-resolution forums in Kenya.

These Terms, together with the Privacy Policy, set out the full terms governing your use of the Service.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

A failure to enforce a provision immediately does not waive the right to enforce it later.
